Dear Sir/Madam,
I refer to your planning application which was lodged with the Planning Authority on the 17/05/2024.
On inspection of the land to which the application relates, the Planning Authority considers that the requirement of Article 17(1)(b), 19 or 20 of the Planning and Development Regulations 2001 (as amended) has not been met or the information submitted in the planning application is substanitally incorrect or substantial information has been omitted. Notwithstanding the fact that an acknowledgement has been sent, your planning application is therefore invalid, in accordance with Article 26(4) of the Regulations.
There are two issues with the application. Firstly, that the drawings and documents are substantially incorrect as they depict/describe structure as existing but which has been demolished (fully or partially) and seeks permission for development which has already occurred. The second issue is that works have occurred on site which would appear to constitute development and where the applicant has failed to seek retention permission for same. While the widening of the entrance and partial demolition of two storey building along the southern boundary are clear examples where retention should have been sought. Other aspects of development including all engineering installation/infrastructure, ground level changes in excess of 1m (site clearance and spoil heap) and demolition of wall connecting dwelling to building on southern boundary may also require retention permission and the onus is on applicant to review all development which has occurred on site and consider what elements require retention permission.
Application, drawings, etc. are returned herewith.
It will be necessary for you to make a new application including revised site and press notice in compliance with the requirements of the Planning and Development Regulations 2001 (as amended).
